These terms explain what you can expect from this website and from Source One Realty, and what we ask of you in return. Please read them before using the site or requesting a consultation.
1. Agreement to these terms
This website is operated by Source One Realty (“Source One Realty,” “we,” “us,” or “our”), a real estate brokerage and property management company serving Naples, Marco Island, Bonita Springs, Estero, and the surrounding Southwest Florida market, as well as Cleveland, Lakewood, Ohio City, Tremont, and the greater Northeast Ohio market. By visiting this website, browsing our service pages, submitting a consultation request, calling a number listed here, or otherwise interacting with us through this site, you agree to these Terms & Conditions and to our Privacy Policy and Cookie Policy, which are incorporated here by reference.
If you do not agree with any part of these terms, please do not use the site. We may update these terms from time to time as our services, technology, or legal obligations change. The “last updated” date above always reflects the current version, and continued use of the site after a change means you accept the revised terms. Material changes that affect an active client relationship will also be communicated directly through the written agreement that governs that relationship.
2. What this website is — and is not
This website is an informational and marketing resource. It describes how we help buyers, sellers, investors, renters, and owners in Southwest Florida and Northeast Ohio, and it gives you a way to start a conversation with a licensed advisor. It is not a listing portal, an offer to buy or sell real property, a solicitation in any jurisdiction where we are not licensed, or a guarantee that any particular service, price, timeline, or result will be available to you.
Nothing on this site constitutes legal, tax, accounting, insurance, engineering, construction, or investment advice. Real estate decisions in Collier and Lee County, Florida, and Cuyahoga County, Ohio, involve variables we do not control — flood zone determinations, wind mitigation and insurance pricing, condominium and homeowner association documents, milestone inspections and structural reserve studies, permitting timelines, short-term rental ordinances, county assessments, and shifting seasonal demand. Before you commit capital, you should engage your own attorney, CPA, insurance agent, and licensed inspectors. We are glad to coordinate with those professionals, but we do not replace them.
3. Consultations, inquiries, and no agency by default
Submitting the consultation form, calling, texting, or emailing us does not by itself create a brokerage relationship, a fiduciary duty, a property management engagement, or any form of representation. Under Florida and Ohio law, an agency or transaction-broker relationship is established only through the required written disclosures and a signed agreement. Until such an agreement exists, information you share with us is treated as a general inquiry and we owe you honesty and confidentiality regarding your contact information, but not the duties of a retained agent.
When we do begin work together, the specific written agreement for that engagement — listing agreement, buyer representation agreement, management agreement, or consulting scope — controls. If anything in those documents conflicts with these website terms, the signed agreement governs the services it covers.
4. Accuracy of information and forward-looking statements
We take reasonable care with the content published here, including market commentary, neighborhood descriptions, rental strategy explanations, management service descriptions, fee ranges, and educational articles. Even so, the Southwest Florida and Northeast Ohio markets move quickly and information can become outdated between updates. Statistics, ranges, examples, and illustrations are provided for general orientation only and are not promises.
Any statement about potential rent, occupancy, appreciation, cap rate, renovation cost, insurance cost, or hold-period return is an estimate based on assumptions that may not apply to your property or your timing. Past performance of a neighborhood, asset class, or rental model does not predict future performance. You are responsible for verifying every number that matters to your decision, and we will always tell you which figures are verified and which are estimates when we put a plan in writing for you.
5. Acceptable use of the site
You agree not to use this website to do any of the following:
- Submit false, misleading, or third-party contact details, or impersonate another person or business.
- Scrape, harvest, crawl, mirror, or bulk-copy content, images, or contact information for resale, lead generation, or model training without our written permission.
- Attempt to probe, bypass, disable, or interfere with the security, authentication, or availability of the site or the systems behind it.
- Upload or transmit malicious code, spam, or unsolicited commercial or political messaging through any form on this site.
- Use the site in a way that violates fair housing law, discriminates against any protected class, or misrepresents property, licensure, or agency status.
- Reproduce our brand, logo, photography, or written content as your own marketing material.
We may restrict or block access to the site, and decline to respond to inquiries, if we reasonably believe this section has been violated.
6. Intellectual property
The Source One Realty name, logo, wordmark, page layouts, photography, video, iconography, copy, checklists, underwriting frameworks, and educational material on this site are owned by us or licensed to us and are protected by copyright, trademark, and related law. You may view, download, and print pages for your own personal, non-commercial evaluation of our services. Any other use — republication, redistribution, derivative works, framing, commercial use, or use as training data — requires our prior written consent.
If you send us feedback, testimonials, questions, or suggestions, you grant us a non-exclusive, royalty-free right to use that material to improve and promote our services, with attribution handled as you request. We will not publish a testimonial that identifies you without your permission.
7. Third-party links, tools, and portals
The site may link to third parties such as tenant and owner portals, maintenance intake tools, listing syndication services, mapping providers, insurance or lender resources, county and municipal websites, association document repositories, and analytics or scheduling providers. Those services are governed by their own terms and privacy practices. We choose partners carefully but we do not control their content, availability, pricing, or data handling, and we are not responsible for them. Review their terms before you rely on them or share information with them.
8. Communications, SMS, and consent
When you provide a phone number and choose a preferred contact method, you authorize us to contact you about your inquiry through that channel. If you separately opt in to text messaging, you consent to receive SMS messages from Source One Realty about real estate services, investment opportunities, appointment details, and customer support. Message frequency varies, and message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance at any time. SMS consent is never a condition of buying, selling, renting, or receiving management services from us.
9. Fair housing and equal opportunity
Source One Realty supports and complies with the federal Fair Housing Act, the Florida Fair Housing Act, the Ohio Fair Housing Law, and all applicable state and local equal opportunity requirements. We do not discriminate in the sale, rental, financing, advertising, or management of housing on the basis of race, color, religion, sex, national origin, familial status, disability, or any other characteristic protected by law. Any neighborhood, lifestyle, or community description on this site is intended to describe property and location characteristics, not the people who live there. If you believe any content here falls short of that standard, tell us and we will correct it.
10. Disclaimers and limitation of liability
The website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
To the maximum extent permitted by law, Source One Realty and its owners, agents, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost rents, lost opportunity, or loss of data, arising out of or relating to your use of this website — even if we were advised of the possibility of such damages. Where liability cannot be excluded, our total aggregate liability relating to the website is limited to one hundred U.S. dollars (USD $100). These limits do not apply to obligations under a signed brokerage or management agreement, which carry their own terms, nor do they limit any liability that cannot lawfully be limited, including duties imposed on licensees under Florida or Ohio real estate law.
11. Indemnification
You agree to indemnify and hold harmless Source One Realty and its personnel from claims, damages, liabilities, and reasonable expenses arising from your misuse of the site, your violation of these terms, your infringement of a third party’s rights, or your submission of information you were not authorized to share.
12. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute relating to this website will be brought exclusively in the state or federal courts located in Collier County, Florida, or Cuyahoga County, Ohio, depending on which market the underlying services relate to, and you consent to the personal jurisdiction of those courts. Before filing anything, we ask that you contact us so we can try to resolve the issue directly — in our experience most misunderstandings are settled in a single phone call.
13. Severability, waiver, and entire agreement
If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding your use of this website.
